These Terms and Conditions govern access to, registration for and use of WaFloW.ai. Please read them carefully before using the service.
1. Provider
WaFloW.ai is a software-as-a-service (SaaS) platform operated by Clic and App Agency SL (hereinafter «WaFloW.ai», «WaFloW» or «the Platform»). Contact: soporte@waflow.ai.
2. Purpose
These Terms govern access to, registration for and use of the Platform. By signing up or using the service you accept this document. If you use it on behalf of a company, you confirm that you are authorised to bind it.
3. Description of the service
WaFloW.ai provides tools to manage, automate and measure a business's communications with its customers —mainly over WhatsApp, email and SMS—, together with CRM, calendar, AI agents, automations, message broadcasts and integrations with third-party services. The features available depend on the plan.
Plans, the free trial, billing and refunds are governed by the Payments and Refunds Policy.
4. Third-party services connected by the user
To use the Platform, the user connects third-party services. For example: their WhatsApp number, their Meta or Google accounts, AI, voice or SMS providers, or other applications.
Each connection is made with the user's own accounts, numbers and credentials, at their own decision and under their own responsibility.
Those services are governed by their own terms. WaFloW.ai does not control them and does not guarantee their operation, their availability or that they will keep their features.
5. Compliance with the terms of connected services
5.1. The user agrees to comply with the terms, policies and usage rules of every service they connect to the Platform —including those of WhatsApp and Meta— and with the applicable law on commercial communications and data protection. In particular, the user must obtain their contacts' consent before messaging them where the law or those policies require it, and must honour opt-out requests.
5.2. The providers of those services may limit, suspend or block numbers, accounts or features, temporarily or permanently, at their own discretion.
5.3. WaFloW.ai cannot prevent or reverse those decisions and will not be liable for their consequences, such as loss of access to a number or account, or loss of conversations or history.
6. Artificial intelligence
6.1. AI agents and features generate automatic replies based on the configuration and information provided by the user, through the AI provider the user chooses. Replies may contain errors.
6.2. The user decides which agents to enable, what information and tools they get and what actions they may take. The user is responsible for reviewing and supervising them.
6.3. When the user connects their own key or account with an AI provider, that use is also governed by the provider's terms, and the provider bills the user directly.
6.4. WaFloW.ai does not guarantee the accuracy, suitability or outcome of the generated replies.
7. Beta features
Some features may be offered as «beta» or «in testing». They may change, be limited or be withdrawn without notice, and are provided with no availability guarantee.
8. Registration and account use
The user is responsible for:
- the accuracy of the information they provide;
- keeping their credentials safe;
- all activity carried out from their account;
- the people they give access to and the permissions they assign them.
9. User obligations and responsibility
The user is solely responsible for:
- the content of the messages they send, whether directly, through broadcasts, automations or AI agents;
- compliance with applicable law;
- respecting the terms of the services they connect;
- the lawful use of the data they process on the Platform.
10. Prohibited uses
WaFloW.ai may not be used for:
- spam or unsolicited messages;
- fraud, impersonation, phishing or scams;
- illegal, abusive, discriminatory or hateful content;
- harassment or threats;
- any content involving the sexual exploitation or abuse of minors;
- any activity contrary to the law or to the terms of the connected services.
11. Data protection
The processing of personal data is governed by the Privacy Policy. For the data of the customers and contacts the user manages on the Platform, the user is the data controller and WaFloW.ai acts as processor, following the user's instructions.
12. Security
WaFloW.ai applies reasonable technical and organisational measures to protect information and processes data only to provide the service. No system is completely secure. WaFloW.ai does not sell or trade its customers' data.
13. Service availability
WaFloW.ai does not guarantee:
- uninterrupted availability of the service or 100% uptime;
- flawless execution of automations or agents;
- the stability of connected third-party services.
14. Suspension and termination
WaFloW.ai may suspend or cancel access in the event of:
- breach of these Terms;
- improper or unlawful use;
- technical or legal risk;
- non-payment.
The user may stop using the service and cancel their subscription at any time. After termination, data may be permanently deleted, as set out in the Privacy Policy.
15. Intellectual property
The rights to the Platform, the software, the WaFloW brand and its content belong to Clic and App Agency SL. Using the service does not transfer any intellectual property rights to the user. Content uploaded by the user remains theirs.
16. Disclaimer of warranties
To the extent permitted by law, the Platform is provided «as is», without express or implied warranties about its operation or its fitness for a particular purpose.
17. Limitation of liability
To the maximum extent permitted by law, WaFloW.ai will not be liable for indirect damages, data loss, loss of profits, blocking of numbers or accounts decided by third parties, or service interruptions.
18. Changes
WaFloW.ai may change these Terms. It will publish the new version with its date and, if the change is significant, will give notice by email or within the Platform. Continuing to use the service means accepting the changes.
19. Governing law and contact
These Terms are governed by Spanish law, without prejudice to mandatory European Union rules or to the rights that the law grants consumers in their country of residence.
